Please read the terms and conditions below carefully. Subscribing to EdPlace.co.uk signifies your acceptance of these. Particular attention is drawn to the User Authority, Cancellation and Refund clauses

EdPlace.co.uk Terms & Conditions

These Terms and Conditions govern your use of EdPlace site (EdPlace site, we or us). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not use or become a member of the EdPlace Site.

Use of the EdPlace site

You will be able to access some areas of the EdPlace site without registering as a member. However, by accessing any part of EdPlace site you agree to be bound by these Terms and Conditions.
THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS

1. Your Contract

Your contract is with Enjoy Maths Ltd, trading as EdPlace.co.uk, a private limited company incorporated in England

2. User Authority

If you subscribe to the EdPlace site, your use of the site is restricted according to the User Package that you have registered for:

Individual — Use of the site us restricted to the subscribing individual and your household (if applicable), and/or any children/pupil(s)/student(s) in your care. This user authority is for non professional users, primarily for home use. You may not allow use of the site under your user ID to other households or unrelated individuals

Trainee Teachers — Use is restricted to bona fide individual trainee teachers with proof of status. The subscription must be discontinued after qualification or curtailment of studies. Material may be used for genuine professional purposes in lesson preparation or classroom use. Material may not be shared with other professionals. You may not allow use of your User ID by other education professionals or unrelated individuals

Teachers/Tutors — Use is restricted to the registering individual in your professional capacity and in the course of your employment for the teaching/tutoring of individuals, classes, or groups of students. You may not sell, hire or otherwise use any material from the site for other commercial purposes. You may not share your User ID with other education professionals or other unrelated individuals

Schools/Education Centre — Use is for multiple access by departments/groups of teachers and tutors, and is restricted to the premises of the school or education centre making the registration. The User ID may not be passed onto individual professionals or students outside the premises

3. Subscription Periods

Our subscription periods are:

Monthly

1 Calendar month

Quarterly

3 Calendar months

Half Yearly

6 Calendar months

Annually

12 Calendar months

Subscription [ackages for schools and education centres are available for 6 and 12 months only.

4. Validity of Subscription Plan

Subscription rates are contained on the Subscription Page and may be changed from time to time. However, once you have subscribed to a subscription plan, we will not increase your subscription fees for that subscription plan. We reserve the right to vary the subscription fees for any future subsequent plan that you may take out

5. Payment for the Subscription Plan

You can pay membership fees by any Mastercard or Visa credit card, or Maestro, Visa Electron, Delta, Switch, Laser or Solo debit cards. All payments are processed by Worldpay (part of Royal Bank of Scotland) and no credit/debit card details are stored on EdPlace site.

At the time of registration, your credit/debit card will be charged for the Initial Membership Term you specified. Thereafter you will be charged monthly, quarterly, half yearly or yearly until your membership is cancelled. Details of pricing are shown within the sign-up process. Prices are expressed inclusive of any VAT payable. Any reduction or increase in the monthly membership price will take effect in your next membership term following notification. Your membership term begins on the next calendar date after the date on which your Initial Membership Term ends and finishes on the day before the calendar date of the following term.

Schools and Education Centres may pay by cheque against invoice and purchase order

From time to time we may offer special discounts or promotions and your eligibility for these will be according to the terms posted with those discounts or promotions

6. Cancellation Request

All cancellation requests must be received by EdPlace.co.uk at least 24 hours prior to the renewal date of your subscription period. We will attempt to process all cancellation requests within 24 hours after we receive the request. If you cancel your membership less than 24 hours prior to the renewal of your Membership period and you are charged for the next Membership period, you should contact our customer service department at customercare@edplace.co.uk. We reserve the right not to make any refund in these circumstances

All cancellation requests must give your first name, last name and user id and inform us of your intention to cancel. You are free to set your account to cancel at any time during your membership but we reserve the right not to give refunds for any unused subscription period

7. Refunds

We provide our members with a «cooling off period» that gives an opportunity to cancel the subscription by giving notice of cancellation to the EdPlace site. The duration of the cooling off period is 7 days from the initial subscription payment

A full refund will be issued within 14 working days after receiving the cancellation notification. All cancellation requests should be emailed to customercare@edplace.co.uk. Cancellations notified and refunds requested after the cooling off period are given at the discretion of the company management

8. Your Obligations to Us

When you subscribe to EdPlace.co.uk, you agree to abide by the terms and conditions in this agreement. Specifically you agree not to use any material contained on this site, or downloaded from this site for commercial hire, rent or resale except with the express written permission of an authorised officer of Enjoy Maths Ltd (t/a EdPlace.co.uk)

9. Amendments

We may update these Terms and Conditions from time to time. You should periodically review them for changes, although where possible we will try to bring any changes to your attention by email and/or by putting a notice on the EdPlace Site. If you continue to use the EdPlace site after the date on which any changes come into effect, your use of the EdPlace site indicates your agreement to be bound by the new Terms and Conditions. If you do not wish to accept the new Terms and Conditions you should not continue to use the EdPlace site and, if applicable, you should cancel your membership (the original Terms and Conditions applying up to the date of cancellation)

10. Membership

To register as a member of the EdPlace site you must be over eighteen years of age. You must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details. You may choose your initial membership term (Initial Membership Term) — one calendar month; one calendar quarter; one calendar half-year or one calendar year. Unless specified otherwise on the EdPlace site, membership is automatically renewed after the Initial Membership Term and on each anniversary thereafter. Members automatically receive a complimentary subscription to EdPlace newsletter and any other related information unless you have chosen to opt-out of such information and promotional mailings when subscribing. We may hold information that you provide to us (such as on an application or registration form) or that we may obtain from another source (such as our suppliers, marketing organisations or credit reference agencies). This information («Your Information») may include your name, address, date of birth, gender, telephone numbers, email address, occupation and employment data, lifestyle information and details of how you use our products and services

In the event that we undergo re-organisation or are sold to a third party, you agree that your Information may be transferred to that re-organised entity or third party for the purposes and subject to the terms of this Agreement

11. Password and Security

If you register to become a member of the EdPlace site you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities that occur under your password. If you know or suspect that someone else knows your password you should notify us by contacting Customer Services at customercare@edplace.co.uk immediately.

12. Excluded Services

The services provided by EdPlace site do not include the provision of computer or other necessary equipment to access the site. To use the EdPlace site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.

13. Intellectual Property

The content of the EdPlace site is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the EdPlace site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. Teachers, tutors, trainee teachers, schools and education centres may reproduce multiple copies of material, or otherwise store material on equipment in the course of employment and professional duties but may not otherwise sell, hire or otherwise use material for commercial gain. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the EdPlace site without written permission from Enjoy Maths Ltd.

14. Availability of the EdPlace site

Although we aim to offer you the best service possible, we make no promise that the services at the EdPlace site will meet your requirements. We cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to customercare@edplace.co.uk and we will attempt to correct the fault as soon as we reasonably can. EdPlace does not suspend or cancel members’ accounts without prior notification to the member.

Your access to the EdPlace site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.

15. Suspension and Cancellation of Membership

We may suspend or cancel your membership immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.

16. Enjoy Maths Ltd Liability

Although Enjoy Maths Ltd will use reasonable skill and care in providing the EdPlace site, we give no other warranties or guarantees in relation to the EdPlace site. You must bear the risks associated with the use of the Internet.

From time to time the EdPlace site provides content from other Internet sites or resources and, while we try to ensure that material included on the EdPlace site is correct, reputable and of high quality, we cannot accept responsibility if this is not the case. Enjoy Maths Ltd will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the EdPlace site. If we are informed of any inaccuracies in the material on the EdPlace site we will attempt to correct the inaccuracies as soon as we reasonably can.

In particular, we disclaim all liabilities in connection with the following:

  • incompatibility of the EdPlace site with any of your equipment, software or telecommunications links;
  • technical problems including errors or interruptions of the EdPlace site;
  • unsuitability, unreliability or inaccuracy of the EdPlace site;
  • inadequacy of the EdPlace site to meet your requirements.

 

You agree that we will not be liable to you for any losses related to any business interests that you have, such as lost data, lost profits or business interruption.

Nothing in these Terms and Conditions shall exclude Enjoy Maths Ltd’s liability for personal injury or death caused by our negligence.

17. Third Party Websites

As a convenience to EdPlace customers, the EdPlace site includes links to other web sites which are beyond our control. We are not responsible for content on the Internet or World Wide Web pages on any other site or publication outside the EdPlace site

18. Advertising and Sponsorship

Part of the EdPlace site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the EdPlace site complies with relevant laws and codes. We are not responsible for any error or inaccuracy in advertising and sponsorship material

19. Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.

20. International Use

Enjoy Maths Ltd makes no promise that materials on the EdPlace site are appropriate or available for use in locations outside the United Kingdom and the Republic of Ireland, and accessing the EdPlace site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom and the Republic of Ireland, you do so on your own initiative and are responsible for compliance with local laws.

21. Miscellaneous

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

If you breach these Terms and Conditions and Enjoy Maths Ltd ignores this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

Enjoy Maths Ltd shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond our control.

A person who is not a party to these Terms and Conditions shall have no rights under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
